These Terms apply to all visitors, customers, and others who interact with the Site or engage Amarillo Deck & Fence for services. Amarillo Deck & Fence provides residential deck construction, fence installation, pergola installation, patio covers, and related outdoor structure services in Amarillo, TX and the surrounding Texas Panhandle region. Services are performed at the customer's property by appointment.
We reserve the right to decline any project at our discretion. Service availability may be affected by weather conditions, permit timelines, material availability, or scheduling constraints. We will communicate any limitations or delays as promptly as possible.
All written estimates provided by Amarillo Deck & Fence are based on the scope of work described at the time of the site visit and are valid for 30 days from the date of issue unless otherwise noted. Estimates are not a guarantee of final price.
Final pricing may change if the scope of work changes, if unforeseen site conditions are discovered after work begins, or if material costs change significantly between the estimate date and the project start date. Any changes to the original scope will be communicated to you in writing before additional work is performed.
Free on-site estimates carry no obligation to hire us. Verbal quotes are not binding. Only written, signed agreements constitute a contract for services.
Once a project is scheduled, a start date will be confirmed in writing. We make every reasonable effort to begin work on the agreed date. Delays may occur due to weather, permit approval timelines, material delivery, or circumstances beyond our control. We will notify you of any delay as soon as we are aware.
If you need to reschedule or cancel a confirmed project, please contact us at estimates@amarillodeckandfence.com or (806) 468-6064 as soon as possible. Cancellations made after materials have been ordered or after work has begun may result in charges for materials purchased and work completed to that point.
Payment terms will be specified in each written project agreement. In general, a deposit may be required before materials are ordered and work begins. The remaining balance is due upon project completion unless otherwise agreed in writing.
Accepted payment methods will be noted in your project agreement. Invoices not paid within the agreed timeframe may be subject to a late fee as specified in the agreement. Amarillo Deck & Fence reserves the right to suspend or discontinue work on a project if payment is not received according to the agreed schedule.
All prices are in U.S. dollars. Sales tax will be applied where required by TX law.
Where required, Amarillo Deck & Fence will apply for the necessary building permits on behalf of the customer. Permit fees are typically included in or added to the project agreement. The customer is responsible for providing access to the property for city inspections and must ensure that any homeowners association (HOA) approvals are obtained before work begins, unless we have agreed in writing to assist with that process.
We build to the applicable codes and standards in Amarillo, TX. If a project requires work to comply with HOA rules, the customer is responsible for providing those guidelines in advance. Changes required to meet HOA specifications after work has begun may result in additional charges.
To ensure a smooth project, customers are responsible for the following:
Amarillo Deck & Fence warrants that all work will be performed in a workmanlike manner using materials specified in the project agreement. Specific warranty terms, including duration and covered defects, will be stated in your written project agreement.
Manufacturer warranties on materials (such as composite decking boards, railings, and hardware) are passed through to the customer to the extent permitted by the manufacturer. Amarillo Deck & Fence is not responsible for warranty claims related to product defects; those claims must be directed to the manufacturer.
Warranties do not cover damage caused by misuse, neglect, natural disasters, weather events, acts of vandalism, modifications made by others, or normal wear and tear. Warranty coverage requires that the customer follow any maintenance guidelines provided at project completion.
Except as expressly stated in a written warranty, the Site and our services are provided "as is" without warranties of any kind, either express or implied, including warranties of merchantability or fitness for a particular purpose.
To the fullest extent permitted by law, Amarillo Deck & Fence, its owners, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to our services or your use of this Site, even if we have been advised of the possibility of such damages.
Our total liability to you for any claim arising from our services shall not exceed the total amount you paid us for the specific project giving rise to the claim. This limitation applies regardless of the legal theory asserted, whether contract, tort, strict liability, or otherwise.
All content on this Site, including text, images, logos, and design elements, is the property of Amarillo Deck & Fence or its content suppliers and is protected by applicable copyright and trademark laws. You may not reproduce, distribute, or use any content from this Site without our prior written permission.
We encourage you to contact us directly to resolve any concerns. If a dispute arises from our services or these Terms that cannot be resolved informally, the parties agree to first attempt to resolve the dispute through good-faith negotiation. If negotiation is unsuccessful, disputes will be resolved through binding arbitration in Amarillo, TX, under the rules of the American Arbitration Association, unless both parties agree otherwise in writing.
Notwithstanding the above, either party may seek emergency injunctive or other equitable relief from a court of competent jurisdiction to prevent irreparable harm pending resolution of a dispute.
These Terms and Conditions are governed by the laws of the State of Texas, without regard to its conflict of law provisions. Any legal action not subject to arbitration shall be filed in the courts of Potter County, Texas.
We may revise these Terms at any time. The updated version will be posted on this page with a new effective date. If we make material changes, we will make reasonable efforts to notify you by email or by a notice on this Site. Your continued use of the Site or our services after the effective date of any revision constitutes your acceptance of the updated Terms.
